The extension of tenancies included in the housing decree is making life harder for large investors that bought rental housing portfolios. Their strategy was to sell the homes one by one, but the continuation of leases makes it harder to obtain vacant possession and disrupts exit timetables.

In the residential market, a rented home can be sold, but the buyer is usually bound by the existing lease under the terms set by law. That is why legal extensions matter: they prolong the tenant’s occupation of the property and can affect the type of buyer interested and the valuation of the asset.

For a small landlord, the case underlines the need to review the length, extensions and contractual position before selling. For a tenant, it confirms that a change of owner does not always mean the tenancy ends immediately.
