Spain publishes new housing decrees covering rents, evictions and speculative purchases

The Spanish government has published two housing decrees covering evictions, rental contracts, purchases by investment funds and help for first-home buyers. The measures include extending the ban on speculative purchases until 2030, mandatory rent contract extensions, more transparency in adverts, rules on seasonal lets and requiring public authorities to take on vulnerable tenants’ debts to prevent evictions. The Sabadell Property Chamber criticised the approach, saying it had set landlords and tenants against each other.

The Official State Gazette has published two housing royal decree-laws with measures on rents, evictions, speculative purchases and support for buying a first home. The changes include extending until 2030 the ban on certain purchases by funds, new mandatory lease extensions, greater transparency in adverts, rules for seasonal lets and the possibility of public authorities taking on vulnerable tenants’ debts to prevent evictions.

A royal decree-law takes effect as an urgent measure, although it must be ratified by Congress if it is to remain in force. Some provisions may have their own implementation timetables. The package sits within the housing affordability crisis and the tension between protecting vulnerable households, containing prices and maintaining enough rental supply.

For landlords and tenants, the practical impact will depend on the applicable text and its parliamentary ratification. Contracts, adverts and planned transactions should be reviewed if the measures are consolidated.
